Travelers whose flight is heavily postponed or cancelled have the right to payment under European law. Payment is also per individual, so for a household of four, quadruple it (although where a passenger takes a trip free of charge - a child, for instance - you can not claim). BUT payment is based in euros, suggesting the quantity you'll get in sterling will fluctuate, depending upon the currency exchange rate at the time the payment is made. But you don't have to accept these, you're entitled to your payment in money (most likely to be paid by cheque). Sarah is a fantastic example of this, she tweeted us saying: "Thomas Cook provided coupons, so I requested for the cash - no issue, the money's in my account.". Often it can be uncertain whether you fulfill the conditions to obtain compensation.

Similar to welfare packages, the payment you're entitled to is figured out by the length of your flight and for how long the delay is. The table below outlines the different levels of payment you can assert following an air travel delay. For more guidance on delayed flights and to learn your rights if your flight is cancelled, read our post Delayed or cancelled flight?

However your overall hold-up was, it would appear, compounded by what sounds like a technical fault on the second aircraft (which would generally be responsible under EU261 subject to the length of the delay) and then a third hold-up due to operational reasons caused by traveler off loading which might be considered likewise as 'extraordinary in some scenarios) then you MAY have an argument right here.

With the European Union Judgement just recently updating and verifying its stance on compensation, Thomas Cook understanding they had no leg to stand on provided my daughter an amount that both she and I disagreed with. The EU Judgements list 17 short articles of which all are to be dealt with independently, the most important of which to the majority of travelers are those associated to time(Delayed) and compensation amounts associated with the delays. After 2 hours of delay the airline companies are obliged to provide written information about the delay and what options they have. Sadly due to the parents both in the land of nod they missed their in air travel meals.

As the air travel left from the UK then although Sri Lankan Airlines is not EU based your air travel is covered under the EU261 rules. As you were successfully bumped from your air travel due to over reserving it depends whether this was your selection or not. If you decided to go later on then there are no set rules how to claim flight delay compensation as you agree compensation with the airline company. If you are bumped without your contract, you are entitled to compensation, as long as you checked-in for your flight on time.

If you don't think an airline when it states the delay had not been its fault, you can refer the problem to the UK's regulatory authority, the Civil Aviation Authority, another European regulatory authority or the European Consumer Centre. Any of these can liaise with the airline company on your behalf to establish what caused the hold-up. However even then the CAA says it does not independently gather reasons for a flight hold-up and it will count on airlines to describe exactly what caused a delay.

This Easyjet air travel No EZY7133 Liverpool to Menorca (Mahon) Dep 02 July 2011 13:15 was postponed 5hrs due to tech fault on aircraft which they rejected. I am extremely amazed with this business and the outcome that they achieved, specifically when Thomas Cook rejected that we were on this particular air travel! I didn't think that I can get any refund from this company (Wizzair) for my cancelled air travel and all spends which I need to rearrange my arrival and everything else. Thanks a lot for the great job and I will suggest you to all of my buddy ... How much payment you get will depend upon the length of your trip and hold-up duration.
